Terms and Conditions (T&Cs) – ALG Snowmaking

1. Scope
These terms and conditions apply to all orders placed through this online shop.
This online shop is exclusively intended for consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed in nature.

3. Conclusion of Contract

  1. The presentation of products in the shop does not constitute a legally binding offer but an invitation to order.
  2. By clicking the "Buy" button, a binding order is placed. The contract is concluded when the order is confirmed by email or the goods are delivered.

  2. The contract text is stored and sent together with these terms and conditions by email.

5. Prices and Shipping

  1. All prices are final prices. Due to the application of the small business regulation according to §19 UStG, no VAT is shown.
  2. Shipping costs are generally borne by the buyer unless stated otherwise.
  3. Deliveries are made within the EU. Different shipping costs per country are displayed during the ordering process.

6. Delivery

  1. Delivery occurs after successful payment. For payment methods where payment is confirmed immediately (e.g., PayPal), delivery usually takes place immediately after payment is received. For payment methods that require processing time (e.g., advance payment / bank transfer), delivery occurs after receipt of payment.
  2. Delivery times are indicated on the respective product page and are subject to available stock.
  3. If a product is unexpectedly unavailable, the customer will be informed immediately and any paid amounts will be refunded.
  4. If goods are delivered with obvious transport damage, this should be reported to the carrier and the operator as soon as possible.
  5. Delivery is made throughout the EU.
  6. Delivery is made to the shipping address provided by the customer.
  7. If the customer uses a forwarding service, parcel service provider, or any third-party address (e.g. parcel forwarding companies), delivery shall be deemed completed once the goods have been successfully delivered to that address.The risk of loss or damage to the goods passes to the customer upon delivery to the specified address. The seller assumes no liability for any loss, delay, or damage occurring after delivery to such third-party address. The customer is solely responsible for compliance with any import regulations, taxes, and duties in non-EU countries.

7. Payment
Payment is possible via the payment methods offered in the shop (e.g., PayPal / PayPal Express).

8. Retention of Title
The goods remain the property of the owner until full payment has been made.

9. Right of Withdrawal

  1. Consumers have the statutory right to withdraw from the contract within 14 days without giving reasons.
  2. The period begins upon receipt of the goods.
  3. To exercise the right of withdrawal, the customer must inform ALG Snowmaking (Luca Hoffmann, [email protected]) by means of a clear statement.
  4. The buyer bears the cost of returning the goods.
  5. A sample withdrawal form can be found in the separate withdrawal instructions.

10. Warranty / Statutory Rights

  1. The purchase contract is governed by German law.
  2. Statutory warranty rights under German law (§§ 434 ff. BGB) apply for customers purchasing within Germany.
  3. For customers purchasing from other EU countries, the statutory rights granted under applicable EU consumer protection law, including the EU Consumer Rights Directive (2011/83/EU), apply.
  4. Damages resulting from improper use, incorrect installation, or normal wear and tear are not covered by the warranty.
  5. Any information regarding recommended technical requirements is provided for guidance only. The actual performance of the product depends on external factors and the user's equipment.
  6. The products follow a functional, industrial design approach. Minor visual imperfections, particularly on uncoated aluminum surfaces (e.g. scratches or surface marks resulting from manufacturing or handling), are typical for the material and do not affect the functionality of the product. Such characteristics do not constitute a defect.

11. Technical Requirements / Use

  1. The functionality of the products may depend on external factors and the customer’s technical infrastructure (e.g., compressor performance, air supply, hose systems, or environmental conditions). Information on recommended technical requirements is provided to the best of knowledge but does not constitute a guaranteed characteristic. The buyer is solely responsible for ensuring that their technical equipment is suitable for operation.

12. Returns / Contractual Right of Withdrawal

  1. The buyer is liable for any loss in value of the goods if this results from handling that was not necessary to check the condition, properties, or functionality.
  2. Return costs are borne by the buyer.
  3. Refunds are made no later than 14 days after receipt of the returned goods.

13. Liability / Guarantee

  1. Unlimited liability applies in cases of intent, gross negligence, injury to life, body, or health, and expressly given guarantees.
  2. In cases of slight negligence, liability is limited to the typically foreseeable damage.
  3. No voluntary guarantee in the legal sense is assumed. Damages resulting from improper use, incorrect installation, or unsuitable external devices (e.g., compressor performance, hose systems) are not covered by liability.
  4. No liability is assumed for damages or functional restrictions resulting from operation outside the recommended technical requirements.

14. Dispute Resolution

  1. Consumers have the possibility to participate in online dispute resolution via the EU Commission platform: https://ec.europa.eu/consumers/odr
  2. Participation in a dispute resolution procedure before a consumer arbitration board is neither mandatory nor intended.
  3. These terms and conditions and all contracts concluded through this online shop are governed by the laws of the Federal Republic of Germany.

15. Governing Law

  1. These terms and conditions and all contracts concluded through this online shop are governed by the laws of the Federal Republic of Germany. If the customer is a consumer residing in another EU member state, the mandatory consumer protection provisions of the law of that country remain unaffected.
